Postanowienia ogólne

1. Regulamin określa zasady sprzedaży licencji na program 2DR3 za pośrednictwem sklepu internetowego działającego pod adresem https://adres.sklepu.
2. Kupujący akceptuje Regulamin przed złożeniem zamówienia. Bez akceptacji złożenie zamówienia nie jest możliwe.
3. Sprzedawca udostępnia Regulamin nieodpłatnie w postaci umożliwiającej jego pobranie, utrwalenie i wydrukowanie.

Definicje

• Program — oprogramowanie 2DR3 do fotogrametrii i rekonstrukcji 3D.
• Licencja — uprawnienie do korzystania z Programu w zakresie i okresie wynikającym z wybranego planu.
• Klucz licencyjny — ciąg znaków przypisany do adresu e-mail Kupującego, służący do aktywacji Programu.
• Stanowisko — pojedyncze urządzenie, na którym aktywowano Licencję.
• Konto — zbiór danych Kupującego w sklepie, dostępny po zalogowaniu.
• Konsument — osoba fizyczna dokonująca zakupu niezwiązanego bezpośrednio z jej działalnością gospodarczą lub zawodową.

Rodzaje licencji

1. Licencje sprzedawane są w modelu subskrypcyjnym, w okresach rocznym lub miesięcznym, w planach różniących się zakresem funkcji i liczbą Stanowisk. Aktualny zakres i ceny podaje cennik w sklepie.
2. Licencja jest niewyłączna i nieprzenoszalna. Klucz licencyjny przypisany jest do adresu e-mail podanego przy zakupie.
3. Kupujący może korzystać z Programu na liczbie Stanowisk wynikającej z planu. Zwolnienie Stanowiska (np. przy zmianie komputera) jest możliwe samodzielnie, z poziomu Konta.
4. Zabronione jest odsprzedawanie, wypożyczanie i udostępnianie Klucza licencyjnego osobom trzecim, a także podejmowanie prób obejścia zabezpieczeń licencyjnych.

Zawarcie umowy

1. Złożenie zamówienia wymaga posiadania Konta. Konto zakłada się podając adres e-mail — logowanie odbywa się jednorazowym linkiem wysyłanym na ten adres, bez hasła.
2. Kupujący wybiera plan, potwierdza akceptację Regulaminu i składa zamówienie.
3. Zamówienie wymaga potwierdzenia przez Sprzedawcę. Umowa zostaje zawarta z chwilą potwierdzenia zamówienia i wystawienia Klucza licencyjnego.
4. Sprzedawca może odmówić potwierdzenia zamówienia, w szczególności gdy płatność nie wpłynęła albo dane Kupującego budzą uzasadnione wątpliwości. O odmowie informuje na podany adres e-mail.

Ceny i płatności

1. Ceny podane w sklepie wyrażone są w walucie i są cenami netto / brutto.
2. Dostępne formy płatności: przelew tradycyjny / inne.
3. Dokument sprzedaży wystawiany jest na dane podane przez Kupującego w zakładce rozliczeń na Koncie. Za poprawność tych danych odpowiada Kupujący.

Dostarczenie licencji

1. Po potwierdzeniu zamówienia Klucz licencyjny wysyłany jest na adres e-mail przypisany do Konta oraz udostępniany w Koncie.
2. Program pobiera się samodzielnie ze strony, po zalogowaniu.
3. Okres subskrypcji liczony jest od dnia wystawienia Klucza. Przy przedłużeniu dni doliczane są do końca bieżącego okresu — Kupujący nie traci opłaconego czasu.

Prawo odstąpienia od umowy

1. Konsument ma prawo odstąpić od umowy w terminie 14 dni od jej zawarcia, bez podania przyczyny.
2. Uwaga: prawo odstąpienia nie przysługuje, jeżeli Sprzedawca rozpoczął spełnianie świadczenia (wystawił i udostępnił Klucz licencyjny) za uprzednią wyraźną zgodą Konsumenta i po poinformowaniu go o utracie prawa odstąpienia.
3. Składając zamówienie Konsument wyraża zgodę na natychmiastowe wystawienie Klucza i przyjmuje do wiadomości, że traci wówczas prawo odstąpienia.
4. Oświadczenie o odstąpieniu należy przesłać na adres e-mail Sprzedawcy. Zwrot płatności następuje w terminie 14 dni od otrzymania oświadczenia.

Reklamacje

1. Reklamacje dotyczące działania Programu lub realizacji zamówienia należy zgłaszać na adres adres@kontaktowy, podając numer zamówienia i opis problemu.
2. Sprzedawca rozpatruje reklamację w terminie 14 dni od jej otrzymania.
3. Sprzedawca odpowiada za zgodność świadczenia z umową na zasadach wynikających z powszechnie obowiązujących przepisów.

Aktualizacje i wsparcie

1. W okresie ważności subskrypcji Kupujący otrzymuje aktualizacje Programu bez dodatkowych opłat.
2. Sprzedawca nie gwarantuje zgodności Programu z każdą konfiguracją sprzętową. Wymagania techniczne podano w § 11.
3. Program wymaga okresowego połączenia z serwerem licencji. Praca bez połączenia jest możliwa przez 14 dni od ostatniego odświeżenia licencji.

Dane osobowe

1. Administratorem danych osobowych jest Sprzedawca.
2. Dane przetwarzane są w celu realizacji zamówienia, obsługi Konta, wystawienia dokumentu sprzedaży oraz kontaktu — na podstawie art. 6 ust. 1 lit. b i c RODO.
3. Zakres danych: adres e-mail, dane rozliczeniowe podane przez Kupującego, identyfikator urządzenia (w postaci nieodwracalnego skrótu) oraz historia zamówień.
4. Kupującemu przysługuje prawo dostępu do danych, ich sprostowania, usunięcia, ograniczenia przetwarzania, przenoszenia oraz wniesienia skargi do Prezesa UODO.
5. Szczegóły określa Polityka prywatności.

Wymagania techniczne

• System Windows 10 lub 11 (64-bit).
• Minimum 8 GB RAM (zalecane 16 GB).
• Karta graficzna zgodna z OpenGL 4.1.
• Dostęp do internetu przy aktywacji i okresowym odświeżaniu licencji.
• Aktywne konto e-mail.

Postanowienia końcowe

1. Sprzedawca może zmienić Regulamin z ważnych przyczyn, w szczególności przy zmianie przepisów lub zakresu usług. Zmiana nie wpływa na zamówienia złożone przed jej wejściem w życie.
2. O zmianie Sprzedawca informuje na stronie sklepu z wyprzedzeniem 14 dni.
3. W sprawach nieuregulowanych stosuje się przepisy prawa polskiego.
4. Konsument może skorzystać z pozasądowych sposobów rozpatrywania reklamacji, w tym z platformy ODR: ec.europa.eu/consumers/odr.

General provisions

1. These Terms govern the sale of licences for the 2DR3 software through the online shop at https://shop.address.
2. The Buyer accepts these Terms before placing an order. Without acceptance an order cannot be placed.
3. The Seller makes these Terms available free of charge in a form allowing download, storage and printing.

Definitions

• Software — the 2DR3 photogrammetry and 3D reconstruction program.
• Licence — the right to use the Software within the scope and period of the selected plan.
• Licence key — a character string tied to the Buyer's e-mail address, used to activate the Software.
• Seat — a single device on which the Licence has been activated.
• Account — the Buyer's data in the shop, available after signing in.
• Consumer — a natural person making a purchase not directly related to their business or profession.

Types of licence

1. Licences are sold as subscriptions, for a yearly or monthly period, in plans differing in features and number of Seats. The current scope and prices are listed in the shop.
2. The Licence is non-exclusive and non-transferable. The Licence key is tied to the e-mail address given at purchase.
3. The Buyer may use the Software on the number of Seats included in the plan. Releasing a Seat (for example when changing computers) can be done from the Account.
4. Reselling, renting or sharing the Licence key with third parties is prohibited, as is any attempt to circumvent the licensing protections.

Conclusion of the contract

1. Placing an order requires an Account. An Account is created by providing an e-mail address — sign-in uses a one-time link sent to that address, with no password.
2. The Buyer selects a plan, confirms acceptance of these Terms and places the order.
3. The order requires confirmation by the Seller. The contract is concluded when the Seller confirms the order and issues the Licence key.
4. The Seller may refuse to confirm an order, in particular where payment has not been received or the Buyer's details raise justified doubts. The Seller informs the Buyer of any refusal by e-mail.

Prices and payment

1. Prices shown in the shop are expressed in currency and are net / gross prices.
2. Available payment methods: bank transfer / other.
3. The sales document is issued using the details provided by the Buyer in the billing section of the Account. The Buyer is responsible for their accuracy.

Delivery of the licence

1. Once the order is confirmed, the Licence key is sent to the e-mail address linked to the Account and made available in the Account.
2. The Software is downloaded by the Buyer from the website after signing in.
3. The subscription period runs from the day the Key is issued. On renewal, days are added to the end of the current period — the Buyer does not lose paid time.

Right of withdrawal

1. A Consumer may withdraw from the contract within 14 days of its conclusion, without giving a reason.
2. Important: the right of withdrawal does not apply where the Seller has begun performance (issued and made available the Licence key) with the Consumer's prior express consent and after informing them that they thereby lose the right of withdrawal.
3. By placing an order the Consumer consents to the Licence key being issued immediately and acknowledges the resulting loss of the right of withdrawal.
4. A withdrawal statement should be sent to the Seller's e-mail address. Payment is refunded within 14 days of receiving the statement.

Complaints

1. Complaints regarding the Software or the handling of an order should be sent to contact@address, quoting the order number and describing the problem.
2. The Seller responds to a complaint within 14 days of receiving it.
3. The Seller is liable for conformity of the performance with the contract under generally applicable law.

Updates and support

1. For the duration of the subscription the Buyer receives Software updates at no extra charge.
2. The Seller does not guarantee compatibility with every hardware configuration. Technical requirements are set out in § 11.
3. The Software requires periodic connection to the licence server. It works offline for 14 days from the last licence refresh.

Personal data

1. The controller of personal data is the Seller.
2. Data is processed to fulfil orders, operate the Account, issue sales documents and communicate with the Buyer — under Article 6(1)(b) and (c) GDPR.
3. Scope of data: e-mail address, billing details provided by the Buyer, a device identifier (as an irreversible hash) and order history.
4. The Buyer has the right to access, rectify, erase, restrict processing of and port their data, and to lodge a complaint with the supervisory authority.
5. Details are set out in the Privacy policy.

Technical requirements

• Windows 10 or 11 (64-bit).
• At least 8 GB RAM (16 GB recommended).
• A graphics card supporting OpenGL 4.1.
• Internet access for activation and periodic licence refresh.
• An active e-mail account.

Final provisions

1. The Seller may amend these Terms for important reasons, in particular changes in law or in the scope of services. Amendments do not affect orders placed before they take effect.
2. The Seller announces amendments on the shop website 14 days in advance.
3. Matters not covered here are governed by Polish law.
4. Consumers may use out-of-court complaint procedures, including the ODR platform: ec.europa.eu/consumers/odr.
